Data protection policy
In compliance with the stipulations set out in EU Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, and specifically Article 13 thereof, and Organic Law 3/2018 of 5 December, on the Protection of Personal Data and guarantee of digital rights, BLECUA LEGAL makes this Privacy Policy available to holders of personal data that may be processed by BLECUA LEGAL, in compliance with the principles of legality, loyalty and transparency.

Purpose of processing.
Depending on the data subject, the form of collection and the basis of processing, the purposes of processing may differ:
- Effective delivery of contracted professional services.
- Fulfilment and maintenance of contractual relations.
- Compliance with legal obligations and administrative and judicial decisions, as well as with the measures agreed therein.
- Maintenance and fulfilment of the employment relationship, and among others, for the following purposes: payroll management; constitution of medical, life insurance or pension plans for the benefit of workers; training; management of the payment of part of the payroll in kind through other benefits; management of business trips; management of workers’ participation in corporate sporting events and/or Team Building events; management of the leasing and use of means of transport; management of the internal complaints system; voluntary periodic monitoring of health status and occupational risk prevention; control of absenteeism; publication in company spaces for information purposes, publication on official pages and social networks on the internet, or in magazines or collaborating companies, for the purpose of publicising the company and its professional team; management of company bank cards; management and use of the time control tool.
- Management of job applications and assessment of the profile within pending and future selection processes, in the event that the data subject sends his/her CV, registers or is interested in participating in such selection processes of BLECUA LEGAL, as well as the subsequent management of the recruitment process.
- Sending electronic communications with announcements and news related to our work and our professional services.
Data categories.
Depending on the purpose for which the data is collected, BLECUA LEGAL will process the following categories of data:
- Identification data: name, surname, postal address, e-mail address, image, postcode, telephone, ID card number, vehicle registration number.
- Academic and professional data: education, degree or qualification, CV, professional background and experience, membership of professional bodies or associations.
- User identification keys.
- Commercial information data
- Economic, financial or banking data.
- Location data.
- Health data of clients, contractors and/or workers.
The data requested are adequate, relevant and strictly necessary for the fulfilment of the corresponding purposes, and in no case is the holder obliged to provide them. However, failure to provide them could make it impossible to achieve the purposes of the processing.
Likewise, the owner assures that the data provided to BLECUA LEGAL are true, accurate, relevant and up to date for the purpose for which they are requested, although BLECUA LEGAL reserves the right to carry out any checks that may be necessary to guarantee their accuracy.
In order for BLECUA LEGAL to keep personal data up to date, it is important for the owner to notify BLECUA LEGAL of any changes to such data.
In the event that the customer or user provides third party data, he/she guarantees that he/she has the necessary legitimacy and/or consent, and undertakes to pass on the information contained in these clauses to the owners. In any event, BLECUA LEGAL may carry out the necessary checks to verify this.
Legitimation for the processing of personal data.
The legal basis for the processing of the data, depending on the purpose of the processing, shall be as follows:
- User consent.
- Fulfilment, execution and/or maintenance of contracts and pre-contracts.
- Legitimate interest.
- Compliance with legal obligations.
- Exercise of specific rights in the field of labour law and social security and protection.
- Formulation, exercise or defence of claims.
- Public interest reasons in the field of public health.
The user shall have the possibility and the right to withdraw consent for any specific purpose granted at the time, without affecting the lawfulness of processing based on such prior consent.
Retention of personal data.
Personal data will be kept for the minimum time necessary for the fulfilment of the purpose for which they are processed.
However, some of these personal data may be kept once the purpose for which they have been processed has been fulfilled, in which case, the data will be duly blocked for the periods necessary to comply with other obligations that take effect after the end of the processing, as well as for the fulfilment of tax, labour or other legal obligations, or for the defence or exercise of actions that may arise from the legal relationship with the owner of the data.
Communication of personal data.
Personal data will not be communicated to third parties unless it is strictly necessary for the fulfilment of the purposes for which it is processed, especially in order to comply with the underlying legal relationship, specifically to the Tax Agency and Social Security, Public Administrations, Courts and Tribunals, as well as to persons or entities linked to the Firm, whether as clients, lawyers, solicitors, opposing parties, experts or suppliers.
Exercise of rights.
As the owner of your personal data, the legislation in force grants the owner of the data a series of rights, which are detailed below:
- Right to request access to personal data.
- The right to rectify any data considered inaccurate or to delete them if they are no longer necessary to fulfil the purpose for which they were collected.
- The right to object to the processing of data.
- The right to request the restriction of processing if:
- You understand that the data should be rectified and you wish to limit their processing until such time as your request is answered.
- If the processing that has been carried out does not comply with the law but you do not want us to delete your data.
- Your data is no longer needed for the purpose for which it was collected, but you do not wish it to be deleted.
If this right is exercised, the data will be blocked and will only be processed if you have given your consent; if it is required for use in the formulation or exercise of claims; if it is necessary for reasons of public interest or for the protection of the interests of third parties.
- The right to data portability, having the right to receive from the data controller, in an orderly and structured manner, all the data currently being processed.

Complaints.
If you consider that your data are not being treated correctly by BLECUA LEGAL, you may send your complaints to teresa@blecualegal.com or to the corresponding data protection authority, the Spanish Data Protection Agency being the competent authority in Spain.
Security and Confidentiality.
In order to safeguard and guarantee the security of the personal data supplied by the owners, BLECUA LEGAL has adopted all the technical and organisational measures necessary to prevent their alteration, loss and/or unauthorised processing or access.
The data is treated with the utmost care and confidentiality by all BLECUA LEGAL staff.
Cookies.
Cookies are files that the website installs on the user’s browser or device during browsing, and are used to store information about your visit.
This website uses a session cookie, “language”, with the sole and exclusive purpose of storing the default language of the browser, but if the site supports several languages, then it may be different depending on the selected language, in this case being an express request from the user.
This session cookie lasts as long as the user is browsing the website and is deleted when the browser is closed.
